1. Acceptance of Terms
By accessing this website, you agree to comply with these Terms and Conditions, our Privacy Policy, and any additional guidelines. If you do not agree, please refrain from using our services.
2. Services Provided
Heart and Mind offers counseling, therapy, workshops, and mental health-related services provided by qualified professionals. These services include, but are not limited to, chat, audio, video-based counseling, face-to-face therapy sessions, and various programs.
3. Harm to Oneself or Others
Suicide and acts of self-harm are tragic and complex issues with significant emotional consequences for individuals and their loved ones. While Heart and Mind therapists strive to provide the best support to prevent such incidents, self-harm or suicide can be impulsive and unpredictable. Therefore, Heart and Mind and its therapists cannot be held liable for any such actions taken by clients outside the therapeutic context.
Heart and Mind is not a crisis intervention center and does not provide emergency services outside of scheduled sessions. Clients experiencing a crisis or requiring immediate assistance are strongly advised to contact local emergency services or other available emergency resources.
4. Confidentiality
Client-Therapist Confidentiality:
All therapy sessions are confidential and private. The only records maintained are notes taken by the therapist solely for therapeutic purposes, accessible only to the therapist/psychologist. No personal information, including your name or contact details, will be disclosed without your explicit consent.
Client Responsibilities for Privacy:
- Use a secure internet connection and attend sessions in a quiet, private space.
- Do not record sessions (audio or video) through any device or application.
- Information from sessions must not be shared with third parties or posted on social media.
Exceptions to Confidentiality:
Confidentiality may be breached without consent if:
- There is an immediate risk of harm to yourself or others.
- Abuse, neglect, or exploitation of children, vulnerable adults, or the elderly is disclosed or suspected.
- Disclosure is required by law or court order.
- Public safety or legal obligations necessitate disclosure.
Every effort will be made to involve you in these processes, but safety remains our highest priority.
5. Interaction Beyond the Session
Communication with your therapist outside scheduled sessions should be limited to administrative matters (e.g., rescheduling or clarifications).
Therapeutic support is provided only during scheduled sessions unless otherwise agreed upon for crisis intervention.
6. Emergency and Crisis Situations
If you are experiencing an emergency, please contact local emergency services or a crisis hotline, as Heart and Mind does not provide 24/7 crisis support. Our services are not substitutes for emergency medical care.
7. Consent to Transfer Information
With your written consent, we may share your information with other healthcare providers or support systems if it benefits your care.
Information may be disclosed without consent only when required by law or in cases involving immediate safety concerns (e.g., risk of harm, child protection concerns, or court orders).
If a transfer of care is needed, you will be informed of the purpose, scope, and recipients of the information.
8. Working with Minors
- Clients under the age of 18 require parental or legal guardian consent to access services at Heart and Mind. Proof of guardianship may be requested when necessary.
- Confidentiality with minors is respected; however, parents or guardians will be informed if there is a safety risk or legal requirement.
- Where appropriate, we encourage collaborative communication between the minor and their guardians while respecting the minor's privacy.
9. Booking, Payments, and Cancellations
Session Bookings:
- Appointments can be booked through our Website, WhatsApp, or Instagram.
- Confirmation of bookings will be provided upon successful payment.
- If payment is not made in advance, the slot may be assigned to another client who completes the payment on time.
Payment Methods:
- Payments are accepted via all UPI apps (GPay, PayTM, PhonePe) and direct bank transfers.
- Payment must be completed to confirm bookings.
Cancellation and Rescheduling:
- Clients must inform both the therapist and the Heart and Mind admin team at least 24 hours in advance for rescheduling or cancellations.
- No refunds will be issued for cancellations or reschedules made less than 24 hours before the session. Such instances will be considered last-minute cancellations.
- If a client fails to join within 15 minutes of the scheduled start time, it will be treated as a no-show, with no refund or reschedule possible. A new slot will require fresh booking and payment.
- If the therapist needs to reschedule, clients will be informed in advance, and a new slot will be offered without additional cost.
10. Intellectual Property
Content on the Heart and Mind website and/or social media platforms, including text, logos, graphics, and multimedia, may not be reproduced, distributed, or used without prior written consent. Unauthorized use of any content from the website or related platforms is strictly prohibited and may result in legal action.
11. Privacy

12. Mental Health Act Compliance
Heart and Mind operates in strict compliance with the Mental Health Care Act, 2017, ensuring the protection of clients' rights, including the right to confidentiality, informed consent, and access to quality mental health care. Clients are encouraged to familiarize themselves with the provisions of the Act to better understand their rights and responsibilities.
Under the Mental Health Act, a person with mental illness has the right to confidentiality concerning their mental and physical healthcare. Health professionals involved in care or treatment have a duty to maintain confidentiality, except under the following circumstances:
- (a) Release of information to the nominated representative to fulfill their duties under the Act.
- (b) Disclosure to other mental health and healthcare professionals for providing necessary care and treatment.
- (c) When necessary to protect any person from harm or violence, with only essential information disclosed.
- (d) Release of information to prevent a threat to life.
- (e) Upon orders from relevant statutory bodies, including the concerned Board, Central Authority, High Court, or Supreme Court.
- (f) In the interest of public safety and security.
- (g) Information access by the administration team of Heart & Mind for smooth organizational functioning.
- (h) Information access by supervisors of therapists to ensure the quality of client sessions.
